Terms of Service

Last updated: September 19, 2026. By using BeachCall (beachcall.mehyar.us) you agree to these terms. BeachCall is a product of MehyarSoft (Mehyar Soft LLC).

1. What BeachCall is

BeachCall gives you a daily beach verdict — GO or SKIP, a best-hours window, and a one-line reason — for NYC-area beaches, computed each morning from public marine and weather data.

2. Free tier

Today's verdict for one beach, free, every day, up to 10 verdict views per day per network address. No account required. If data is stale or missing we say "verdict unavailable" instead of guessing.

3. The Summer Pass — $9

The Summer Pass is a one-time $9 payment (no subscription, no renewal) that unlocks, for the current summer season:

• today's verdict for all 8 beaches, every day;
• best-hours windows for each beach;
• a morning go/no-go email;
• a Friday weekend outlook email.

Payment is processed securely by Stripe. Your receipt email carries a private access token that unlocks your pass on any device. Keep it private — anyone with the token can view your pass.

4. No refunds on digital delivery — and what we do instead

The pass is delivered instantly and consumed daily, so we don't offer refunds as a self-serve feature. If your pass never worked (no verdicts, no emails after purchase), email info@mehyar.us within 14 days and we'll make it right — fix it or refund it.

5. A forecast is not a promise

Verdicts are planning guidance computed from forecasts, not guarantees of conditions and not a safety judgment. The ocean changes; data can be wrong or stale. Always follow lifeguard instructions, posted flags, and local advisories. You go to the beach at your own risk.

6. Emails and unsubscribe

We send only the emails you asked for: verdict delivery, pass receipt, morning go/no-go (pass holders), and the Friday outlook (pass holders). Every email carries a one-click unsubscribe link; unsubscribing immediately suppresses your address for BeachCall. We never send marketing campaigns you didn't opt into.

7. Acceptable use

Don't abuse the free tier (automated scraping, circumventing the daily limit), don't resell or share pass tokens publicly, and don't use the service for anything unlawful. We may rate-limit or block abusive clients.

8. Intellectual property

The BeachCall name, design, and verdict presentation are owned by MehyarSoft. You may screenshot and share your own verdict cards — that's what they're for.

9. Limitation of liability

To the maximum extent permitted by law, MehyarSoft is not liable for indirect or consequential damages arising from your use of BeachCall, including a beach day that didn't pan out. Our total liability is capped at the amount you paid us ($9 for pass holders, $0 for free users).

10. Changes

We may update these terms; the date above reflects the latest version. Material changes to the paid tier will be communicated by email to pass holders.
